As we take a fresh look at the status of CBD and novel foods within the European Union, we find that under current rules, cannabinoid-containing hemp extracts could require pre-market authorisation as they are now presumed to be novel. An individual member states’ relevant authority must adopt and implement novel food rule changes, and novel status applies to new foods, food from new sources, new substances used in food and new ways and technologies for producing food. The aim of the new regulation is to allow manufacturers to bring new and innovative foods to market easily.
