Iowa: Market and regulatory data analysis of the cannabis sector

9th August 2024: US - Iowa: Plaintiffs in a lawsuit challenging a recently enacted law that limits the amount of hemp-derived THC beverages can contain have dismissed their lawsuit against state authorities, press reports. The court had twice denied preliminary injunctions to prevent enforcement of House File (HF) 2605, which came into effect on 1st July. Guidelines issued by the Iowa Department of Health and Human Services since the lawsuit was filed have clarified what is considered a “serving” for purposes of the new law, which varies depending on product format.
29th July 2024: US - Iowa: A federal court has again denied a preliminary injunction to prevent the enforcement of House File (HF) 2605, a new law that limits the amount of THC in hemp products, press reports. A court had already denied one request for a preliminary injunction, but the plaintiffs added a claim of vagueness after the court raised concerns about the law's clarity in denying the first injunction petition. However, the court found that guidelines issued by the Iowa Department of Health and Human Services since the initial denial resolved the vagueness issue. Therefore, HF 2605 remains in effect at least until the underlying lawsuit is resolved.
1st July 2024: US - Iowa: A federal court has denied a preliminary injunction to prevent House File (HF) 2605, a new law that limits the amount of THC in hemp products, from taking effect, press reports. While the court denied the injunction, the presiding judge indicated serious concern that the new law could be unconstitutionally vague over what constitutes a serving – an issue not raised by the plaintiffs as grounds for the injunction. However, the plaintiffs have now filed a new complaint to include this claim. A separate lawsuit filed by several CBD companies also seeks to stop the law due to its vagueness.
21st May 2024: US - Iowa: House File (HF) 2605 has been signed into law by governor Kim Reynolds. HF 2605 places a limit of 4 mg of THC per serving in consumable hemp products, as well as a 10 mg limit per container – in addition to requiring warning labels on such products. The new law also imposes an age limit of 21, as well as adding new restrictions and penalties related to the possession, sale and manufacturing of hemp products.
3rd April 2024: US - Iowa: Senate File 2335 has been passed by the Senate and now heads to the House. The bill would increase the number of allowed medical cannabidiol dispensaries in the state from five to ten. While a previous version of the legislation would have restricted licensees to having a maximum of three licensed dispensaries, the Senate amended the bill to remove this requirement.

The bill would put a limit of 4 mg of THC per serving in consumable hemp products, as well as a 10 mg limit per container – in addition to requiring warning labels on such products. The bill would also impose an age limit of 21, as well as add new restrictions and penalties related to the possession, sale and manufacturing of hemp products.
13th March 2024: US - Iowa: House File 2605 – which would provide regulation for hemp and hemp products – has been passed by the House and now heads to the Senate. According to the bill, a maximum total THC concentration of a hemp product should be less than or equal to the lesser of the following: 0.3% on a dry weight basis, or 4 mg per serving and 10 mg per container on a dry weight basis. The bill would also provide sale, labelling and packaging requirements for consumable hemp products.
28th February 2023: US - Iowa: The state Medical Cannabidiol Board has again rejected a petition from Bud and Mary, the only medical cannabis product manufacturer in Iowa, to add “vaporizable flower” as an approved product under the state medical cannabis program, press reports.
21st November 2022: US - Iowa: Iowa’s Medical Cannabidiol Board will recommend to the state legislature that it exempt medical cannabis sales from the state's sales tax and allow legal medical cannabis businesses to deduct business expenses in their state tax filings, press reports. The board will also recommend a study on telehealth prescriptions and potentially adding restrictions to them.
27th April 2022: US - Iowa: House File (HF) 2380 has been signed by the governor and enacted into law. HF 2380 increases the maximum size of a tract of land for hemp cultivation from 40 ac to 320 ac.
30th March 2022: US - Iowa: House File 2380 was passed by the Senate and now heads to the governor for approval. The bill would increase the maximum size of hemp cultivation sites from 40 acres to 320 acres.
25th February 2022: US - Iowa: House File (HF) 2380, which would increase the maximum acreage for hemp crop sites from 40 to 320, was passed by the House by a vote of 96-1 and now heads to the Senate.
