15th October 2024: Italy: European Commissioner for Health and Food Safety Stella Kyriakides responded on behalf of the European Commission (EC) to a parliamentary enquiry regarding the compliance of the Italian security bill – which seeks to limit hemp to industrial uses and ban the cultivation and sale of hemp flowers, regardless of THC content – with European legislation and jurisprudence. Kyriakides said the EC had received multiple complaints on the issue and is currently assessing the compliance of these measures.
16th September 2024: Italy: The Chamber of Deputies has approved the security bill that seeks to restrict hemp to industrial uses only and prohibit the cultivation and sale of hemp flowers, regardless of their THC content. The bill has now been forwarded to the Senate for further discussion and voting. The Department for Anti-Drugs Policies issued a statement saying the bill will not criminalise or impact the cultivation and supply chain of hemp, as it neither prohibits nor limits hemp production and does not create legal or regulatory conflicts with other EU countries and the EU law. However, the bill appears to conflict with the Kanavape case and European regulations. If the bill is ultimately approved, industry associations are expected to file appeals with administrative tribunals.

9th July 2024: Italy: The Ministry of Health has issued a decree that repeals the previous decree that placed “the compositions for oral administration of cannabidiol obtained from Cannabis extracts” in the medicines tables of the Narcotics Act. The repealed decree was awaiting the Regional Administrative Tribunal (TAR) decision on its legitimacy, scheduled for September 2024. The new decree reproduces the same wording, placing “the compositions for oral administration of cannabidiol obtained from Cannabis extracts” in the medicines tables of the Narcotics Act. This decree demonstrates, once again, the hard-line stance against cannabis embraced by the current government under prime minister Giorgia Meloni. We expect industry associations to appeal the decree before the TAR.

The provisions to introduce a regulatory framework for cannabis-based medicines were only slightly amended. The bill returns to the National Assembly for a new reading.

On that day, the TAR will rule on the decree’s legitimacy.

The suspension will remain in effect until 24th October, the day on which the TAR is expected to rule on the legitimacy of the decree.

The ruling has not been published yet.
