North Dakota: Market and legal data analysis of the cannabis sector

6th November 2024: US - North Dakota: Measure 5, which would have legalised recreational cannabis, failed to gain majority support for the third time in six years. Voters rejected the initiative, with 52.5% casting ballots in opposition to adult-use legalisation. Two years ago, a similar measure was rejected, and another attempt in 2018 also failed. Sponsored by New Economic Frontier (NEF), the measure intended to allow adults aged 21 and older to possess up to 1 oz of cannabis and establish a regulated adult-use marketplace for licensed businesses to provide tested products to consumers.
5th November 2024: US - Federal: Today, voters in Florida, North Dakota and South Dakota will vote on ballot initiatives to legalise recreational cannabis in their states while those in Nebraska will vote on medical cannabis measures. The election represents the third time that voters in both North Dakota and South Dakota will decide on this issue. Meanwhile, in Nebraska, voters will vote on a pair of measures that would legalise medical cannabis and establish regulations for the industry.
13th August 2024: US - North Dakota: North Dakota secretary of state Michael Howe has announced that a recreational cannabis legalisation initiative has officially qualified for the November ballot, as Measure 5, with 18,964 approved signatures. In July, the New Economic Frontier (NEF), the organisation behind the measure, submitted over 22,000 signatures to the secretary of state’s office – far more than the minimum requirement of 15,582 to qualify the proposal. “We’re excited for North Dakotans to cast their votes on the legalization of adult-use cannabis in November,” NEF chairperson Steve Bakken said in a public statement. The initiative would establish a new chapter of the North Dakota Century Code to create a licensed and regulated marketplace for those 21 years and older to purchase and possess small amounts of cannabis.
11th July 2024: US - North Dakota: Organisers of a ballot initiative to legalise recreational cannabis in North Dakota say they have submitted more than 22,000 signatures, 15,582 of which must be valid for the measure to reach the November ballot. If enough signatures are validated, voters will decide whether adults (21+) will be allowed to possess, purchase and cultivate certain amounts of cannabis for personal use. The initiative would allow for 18 recreational cannabis dispensaries and 7 manufacturing facilities in the state.
29th April 2024: US - North Dakota: North Dakota secretary of state Michael Howe has approved the format of a petition to initiate a statutory measure on the election ballot related to cannabis legalisation and related regulation. The proposal, if passed, would make it legal for those aged 21 and older to produce, process, sell and use cannabis. To qualify for the November ballot, 15,582 signatures must be gathered from eligible North Dakota voters by 8th July.
18th April 2024: US - North Dakota: Activists have filed an initiative to put adult-use cannabis legalisation on the state’s 2024 ballot. To qualify for the November ballot, 15,582 signatures must be gathered from eligible North Dakota voters by 8th July. Under the new measure, adults 21 and older would be able to possess up to 1 oz of cannabis flower, 4 g of concentrate and 300 mg of edibles that they could buy from a limited number of licensed dispensaries. State voters rejected adult-use legalisation in 2022.
25th April 2023: US – North Dakota: Senate Bill 2096 has been signed into law by governor Doug Burgum. It revises the definition of hemp products to specifically exclude products that contain “chemically derived cannabinoids” – such as delta-8 THC, THCO, HHC, and THCP – and prohibit hemp licensees from selling or distributing products containing chemically-derived cannabinoids. The new law also expressly allows CBD, CBG, broad spectrum, and full spectrum products and requires testing and certain labelling of hemp products.
13th April 2023: US - North Dakota: Senate Bill 2388 has been signed by governor Doug Burgum and enacted into law. This means that medical cannabis patients who have had their registry identification card revoked can reapply a year after an initial revocation and five years after a second, and be permanently disqualified upon a third revocation.

The bill would allow medical cannabis patients and caregivers who have had their registry identification card revoked to reapply after a year, or after five years following a second revocation. A third revocation would mean permanent disqualification.
27th March 2023: US - North Dakota: House Bill (HB) 1478 has been signed by the governor and enacted into law. HB 1478 allows self-certification of an individual aged 65 and older admitted to hospice care as a medical cannabis patient, and that designated caregivers be exempted from a criminal record check process to carry cannabis products for such patients.
23rd March 2023: US - North Dakota: House Bill 1478 has been approved by both chambers and now heads to the governor’s desk. It would allow self-certification as a medical cannabis patient by over-65s admitted to hospice care, and allow designated caregivers to carry cannabis products for such patients without going through a criminal record check .
22nd March 2023: US - North Dakota: Senate Bill (SB) 2388 was amended and passed by the House. It must now be reconciled with the Senate version before heading to the governor’s desk. SB 2388 would allow medical cannabis patients who have had their registry identification card revoked to reapply a year after an initial revocation, five years after a second revocation, and permanently disqualify the patient upon a third revocation.
