13th November 2024: Poland: Members from the Polish Parliamentary Committee on Petitions have requested, through a motion, that the prime minister decriminalise cannabis, press reports. The motion proposes allowing possession of up to 15 g of cannabis and cultivation of up to one plant for personal use. The prime minister, Donald Tusk, now has 30 days to provide a written response and explain whether he will take action and introduce a bill or reject the motion. The Committee members hope that this motion will bring back debate around the decriminalisation of cannabis for recreational purposes. Aside from this proposal, the Parliamentary Team for the Decriminalisation of Cannabis has been formed in the Sejm (lower chamber of parliament) by several members of Parliament (MPs) from the current coalition government.
8th November 2024: Poland: Yesterday (7th November), a regulation amending the prescription regime of cannabis entered into force. The regulation has added medical cannabis to the list of substances that doctors are not able to prescribe to patients during remote or online consultations. This means it now can only be prescribed after in-person examinations with the doctor.
13th September 2024: Poland: Minister of health Izabela Leszczyna has announced she will toughen the requirements to access medicinal cannabis prescriptions, press reports. Medical cannabis has been added to the list of substances that doctors will not be able to prescribe to patients during remote or online consultations. This means it will only be prescribed after in-person examinations with the doctor. However, Leszczyna also announced that the ministry aims to increase the amount of medical cannabis imported into Poland in order to meet the large demand.
17th October 2023: Poland: Parliamentary elections took place in Poland on Sunday, resulting in a likely change of government. Today (17th October), with 100% of the votes counted, the ruling right-wing party Law and Justice (PiS) has obtained the largest amount of votes, but not the majority of seats in the Sejm (Polish Parliament lower chamber) it would need to govern. The sum of the opposition parties – the centre-right parties Civic Coalition (KO), Third Way (TD) and the left-wing Nowa Lewica (New Left) – makes a coalition government led by Civic Coalition leader Donald Tusk a feasible outcome. This will depend on whether TD decides to join the coalition government and give support to Tusk. This government switch could bring about some changes in the cannabis field, as NL’s election programme included the legalisation of recreational cannabis, through a system of licensed local producers and allowing self-cultivation. However, none of the other opposition parties make any reference to cannabis in their programmes.
6th April 2023: Poland: Polish authorities have informed the European Commission (EC) through the TRIS database that the country intends to add HHC-O (hexahydrocannabinol acetate), a synthetic cannabinoid that is an acetate version of HHC, to its list of narcotics. The Polish Bureau for Chemical Substances had previously told CannIntelligence that HHC is already listed as a narcotic.
5th May 2022: Poland: The Ministry of Agriculture has announced that the new regulation on hemp will come into force on Saturday, 7th May. The regulation increases the THC limit from 0.2% to 0.3%. It also extends the list of purposes for which industrial hemp can be grown to textiles, chemicals, paper, cosmetics, pharmaceuticals, energy, seed production, food, veterinary and beekeeping purposes, among others. Hemp cultivation will no longer be monitored by local authorities but by the National Centre for Agricultural Support (KOWR).
7th April 2022: Poland: The Supreme Administrative Court has ruled that extracts from hemp flowers and fruiting tops, including CBD, fall under EU food safety rules, media reports. The ruling overturns the earlier decision of the Chief Sanitary Inspectorate (GIS) to withdraw from the market a product consisting of capsules filled with hemp plant tops produced by the Polish company Kombinat Konopny.
