US FDA gets into local enforcement now ‘rather than play whack-a-mole later’

Recent unusual activity by the US Food and Drug Administration (FDA) could be an attempt to strike a heavy blow now in order to avoid continuing to play whack-a-mole with enforcement as time goes on. That’s the view of a lawyer in Hawaii, where the agency took an active role in a surveillance operation at state level.

The FDA had helped Hawaiian state officials conduct surveillance of retail locations selling CBD products, leading to the arrest of two people. This was a rare step-up in FDA enforcement action related to CBD and an almost unique intervention by the federal agency at a very local level.
