Argentina: Market and legal data analysis of the cannabis sector

7th September 2023: Argentina: The government has approved the inclusion of hemp seeds and their derivatives in the Food Code, press reports. The inclusion allows the sale of these products as food products.
6th September 2023: Argentina: The president of the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (Ariccame) has sent a formal letter to the president of the National Food Commission requesting the inclusion of all hemp derivatives in the list of permitted food products, press reports. In July 2023, the National Food Commission opened for public consultation a draft decree to include hemp seeds and their derivatives in the Food Act, though derivatives from other parts of the plant were excluded from the scope of the draft decree.
7th August 2023: Argentina: Today, 7th August, the government published in the official gazette Decree 405/2023 to further develop and implement Law 27669, which was approved in May 2022 to establish a comprehensive regulatory framework for industrial hemp and medical cannabis. The decree puts all provisions of Law 27669 into operation, including the issuing of licences to cultivate, process and sell hemp and its derivatives; setting the maximum THC limit for hemp at 1%; and establishing the purposes for which hemp derivatives can be commercialised, such as medicines, food, cosmetics and “all those uses that arise from scientific research and industrial development”.
19th July 2023: Argentina: The National Food Commission has opened for public consultation a draft decree to include hemp seeds and derivatives in the list of permitted food products, as well as the requirements for their commercialisation. The consultation, which will end on 12th August, follows a meeting on 29th June, when the commission also agreed to keep examining the scientific evidence on CBD in food products, in order to assess whether it should be permitted in edibles.
4th July 2023: Argentina: The National Food Commission has published the minutes of meetings held on 28th and 29th June, when it agreed to open a public consultation on the inclusion of hemp seeds and derivatives in the list of permitted food products. The commission also agreed to keep examining the scientific evidence on CBD in food products, in order to assess whether it should be permitted in edibles in the future.
20th April 2023: Argentina: The Ministry of Health issued a resolution yesterday extending from one year to three the validity of home growers’, patients’ and prescribing doctors’ registration for medical cannabis through the Cannabis Programme Registry (Reprocann).
11th April 2023: Argentina: A regulation further developing Law 27.669, approved in May 2022, to set up a comprehensive regulatory framework for industrial hemp and medical cannabis, has been approved by the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (Ariccame) and the economy minister and will be published in the Official Gazette once the president has approved it, press reports. The regulation will allow licensing of the production, distribution and sale of hemp and hemp extracts, with a maximum allowed THC content of 1%.
27th February 2023: Argentina: On 24th February, the president of the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (Ariccame), Francisco José Echarren, said that the agency will regulate Law 27.669 within 20 days. Law 27.669 was approved in May 2022 to set up a comprehensive regulatory framework for industrial hemp and medical cannabis, while Ariccame is the agency set up by the same law that is responsible for issuing the regulations further developing the law. These regulations will address licence procedures to cultivate hemp and commercialise its derivatives, as well as the maximum THC content that cultivated hemp must contain.
23rd January 2023: Argentina: The government today issued a decree launching the Regulatory Agency for the Hemp and Medicinal Cannabis Industry (Ariccame), responsible for issuing regulations and permits for hemp-growing, and for setting out terms and conditions for the marketing of hemp extracts. Ariccame was established by Law 27,669, which was approved in May 2022 to set up a comprehensive regulatory framework for industrial hemp and medical cannabis.
19th December 2022: Argentina: Last week, the government published a Q&A on cooperatives and cannabis. The government highlights that cannabis cooperatives for the production and sale of hemp and its derivatives cannot be set up yet, as the executive still needs to issue the regulation further developing Law 27,669, which established a regulatory framework for medical cannabis and industrial hemp and allowed the creation of such cannabis cooperatives. Therefore, the procedure to establish such cannabis cooperatives needs to be set out by said regulation. The government also reminds of the possibility to establish cooperatives for the trade of cannabis seeds, as envisaged by the current regulatory framework.
15th December 2022: Argentina: The National Food Commission held a meeting yesterday, chaired by health minister Carla Vizzotti, to explore the possible inclusion of parts, subproducts and derivatives of the Cannabis sativa plant in the National Food Code.
7th November 2022: Argentina: On 4th November the minister of health, Carla Vizzotti, encouraged doctors to prescribe medicinal cannabis to patients, press reports. The minister also noted the importance of registering new seed varieties and state-allowed investigational projects to advance in medicinal cannabis. She added that there are more than 180,000 registered patients with the Cannabis Programme Registry (Reprocann), a state-controlled register that patients can join to access medicinal cannabis.
