Michigan: Market and legal data analysis of the cannabis sector

13th June 2023: US - New Jersey: The New Jersey Cannabis Regulatory Commission (CRC) has revoked Harmony Foundation’s cannabis cultivation and manufacturing licences due to unpaid licence fees. Across the country, state regulators and government bodies have been implementing significant measures and repercussions against cannabis companies that fail to pay vendors, taxes or business fees. California, Michigan, Nevada, New York and Oregon are some of the states that have been enforcing compliance by tracking miscreants, press reports.
5th December 2022: US - Michigan: House Bill (HB) 5871 has been passed by the Senate and now heads to the governor for final approval. HB 5871 would clarify what activities are allowed under growing and processing licences for medical cannabis and would allow spouses of certain government officials to apply for medical cannabis licences if certain conditions are met and an attestation is included with the application.
29th August 2022: US - Michigan: Michigan State Police is suspending its use of a test for THC impairment in drivers after it became apparent that lab testing was producing false positives when samples contained CBD instead of THC, press reports.
19th April 2022: US - Michigan: The Michigan Cannabis Regulatory Agency (CRA) has reportedly withdrawn a proposed rule that would have allowed for the conversion of hemp cannabinoids into THC. The agency cited public comments on safety concerns and the lack of scientific data.
24th February 2022: Michigan: The Michigan Marijuana Regulatory Agency (MRA) has clarified to CBD-Intel that proposed rules “Industrial Hemp Rules for Marihuana Businesses” – specifically the portion which would cap the overall THC amount in hemp products at 1 mg of THC per serving and 10 mg per container – would apply to all retailers, not just cannabis dispensaries. “The THC cap for hemp products is not limited to marihuana businesses,” the MRA said. Regarding implementation of the proposed rule, the MRA said: “We do not have an anticipated timeline for filing the proposed rules with the secretary of state at this time. The agency needs to review the public comment and determine what, if any, changes will be made to the rule set based upon that comment.” The proposed rules would also allow for the conversion of “industrial hemp concentrate to marihuana concentrate” if approved by the MRA after meeting several requirements.
18th February 2022: Michigan: Two bills that would permit hemp-derived cannabinoids as ingredients in food and dietary supplements were passed by the House and now head to the Senate. House Bill 5617 would allow hemp-derived cannabinoids to be used as ingredients in food and dietary supplements if they meet certain testing and labelling requirements, whereas HB 5058 would state that food and dietary supplements are not adulterated by the inclusion of hemp-derived cannabinoids.
17th February 2022: Michigan: The Michigan Marijuana Regulatory Agency held a public hearing on proposed rules that would allow for the conversion of hemp extracts into cannabis extracts that could be sold in cannabis dispensaries under certain conditions. The proposed rules would also cap the total amount of THC in finished hemp products, though they would appear to apply only to products sold in licensed cannabis businesses.
