Fifteen US states ban the sale of intoxicating hemp-derived cannabinoid (IHDC) products in licensed dispensaries, whereas 11 states allow them. The legal status is unclear in five states, and sales are significantly restricted in seven states.

IHDC products are offered widely in dispensaries across the US, and delta-8 THC is by far the most common IHDC they have for sale.

This report examines which states allow the sale of IHDCs in licensed dispensaries. It also looks into which states have dispensaries offering IHDC products – regardless of whether they are permitted – to demonstrate the states that effectively deter IHDC sales in dispensaries.
