New Hampshire: Market and legal data of the cannabis sector

6th August 2024: US - New Hampshire: Governor Chris Sununu has signed House Bill (HB) 1278 into law. HB 1278 allows healthcare providers to prescribe medical cannabis to adults (21+) for “any debilitating or terminal medical condition or symptom for which the potential benefits of using therapeutic cannabis would, in the provider’s clinical opinion, likely outweigh the potential health risks for the patient”. To do so, the healthcare provider must state the patient’s symptom or condition and the provider’s clinical opinion.
30th July 2024: New Hampshire: Senate Bill (SB) 357 has been signed into law by governor Chris Sununu. SB 357 expands who may prescribe medical cannabis to include any healthcare provider “who is licensed to prescribe drugs to humans and who possesses an active registration from the United States Drug Enforcement Administration to prescribe controlled substances and who is primarily responsible for the patient’s care related to his or her qualifying medical condition”.
15th July 2024: US - New Hampshire: Governor Chris Sununu has signed into law House Bill (HB) 1349, which adds generalised anxiety disorder to the list of conditions for which medical cannabis can be prescribed. Sununu also vetoed HB 1581, which would have allowed Alternative Treatment Centers (ATCs) to add an additional cannabis cultivation site.
17th June 2024: US - New Hampshire: A bill to legalise recreational cannabis in New Hampshire has failed despite each legislative chamber having passed some version of the bill. House Bill 1633 would have created a unique model of cannabis sales by allowing 14 state-run dispensaries. With the two chambers unable to come to a compromise on the bill and the legislative session ending at the end of June, legalisation efforts in the state are stalled until 2025.
27th May 2024: US - New Hampshire: House Bill (HB) 1633 was amended and passed by the Senate. HB 1633 would legalise recreational cannabis but allow sales in a unique franchise model that would be controlled by the state. Since the bill was amended in the Senate, it must be reconciled between the two chambers, which may prove to be a significant challenge.
23rd February 2024: US - New Hampshire: House Bill (HB) 1633 has been passed by the House and now heads to the Senate. HB 1633 would establish procedures for the legalisation, regulation and taxation of recreational cannabis. The bill would further introduce licensing procedures for cannabis establishments.
30th November 2023: US - New Hampshire: A commission tasked with making recommendations on how to regulate recreational cannabis in the state has failed to make any recommendations, press reports. Although a bill that would have allowed state-selected franchisees to sell cannabis with a 15% sales tax was proposed, no consensus was reached. Complicating the matter was governor Chris Sununu threatening at the last minute to veto any bill that allowed more than 15 retail locations and failed to ban political contributions and lobbying by cannabis licensees.
9th August 2023: US - New Hampshire: House Bill (HB) 611 has been signed into law by governor Chris Sununu. The new law eases the qualifying condition for therapeutic cannabis by allowing medical providers to certify their patients for severe pain without prior need of surgery or a failure to respond to previously prescribed medications. It also prohibits the sale of hemp products with more than 0.3% natural or synthetic THC on a dry weight basis, in any formulation, including delta-8 and delta-9 THC or any other THC isomer variant. And it provides for the establishment of a commission to study state-controlled sales of cannabis, assess the viability of legalising cannabis through a state-run model, and propose legislation to enact the reform.
2nd August 2023: US - New Hampshire: House Bill 611 has been enrolled and now moves to the governor’s desk. It will ease the qualifying condition for therapeutic cannabis by allowing medical providers to certify their patients for severe pain without the prior need for surgery or a failure to respond to previously prescribed medications. 11th July 2023: US - New Hampshire: The Therapeutic Cannabis Program now allows out-of-state and Canadian visitors with legal authorisation to purchase therapeutic cannabis from the state’s Alternative Treatment Centers (ATCs). They can make up to three purchases per year and, if their medical condition is approved in New Hampshire, they can buy cannabis at the same frequency as local patients. Each patient can purchase a maximum of 2 oz within a ten-day period and is limited to possessing 2 oz at a time. Visiting patients must adhere to state laws and present their out-of-state cannabis authorisation and photo ID when making purchases.
22nd June 2023: US - New Hampshire: House Bill 611 has been revised by the House/Senate Conference Committee to include a commission to study state-controlled sales of cannabis, assess the viability of legalising cannabis through a state-run model, and propose legislation to enact the reform. The bill must now be approved by both chambers before it goes to the governor’s desk.
16th May 2023: US - New Hampshire: House Bill 639, which would have legalised recreational cannabis, was killed in the Senate after passing the House in February. In response, governor Chris Sununu has expressed his readiness to sign a bill that focuses on harm reduction rather than profits, presenting his take on the “best path forward for adult-use cannabis in NH”. Republican Sununu emphasised the need for the state to have control over marketing, sales and distribution, similar to the liquor industry, without imposing any state taxes and allowing for local control. “Should the legislature pass future legalization bills without these provisions in place, they will be vetoed,” Sununu said.
