South Carolina: Market and legal data of the cannabis sector

17th September 2024: US - South Carolina: Solicitor general Robert Cook issued an opinion letter finding that non-alcoholic beverages containing up to 0.3% delta-9 THC that are derived from hemp are legal under federal and state law. The opinion came in response to a question presented by the speaker of the state House of Representatives asking for clarity, as hemp-derived THC beverages are proliferating across the US.
15th February 2024: US- South Carolina: Senate Bill (SB) 423 has been passed by the Senate and now goes to the House for consideration. The bill would authorise the use of medical cannabis products by patients with any of 14 listed debilitating medical conditions, including cancer, epilepsy and autism. SB 423 would also establish licensing requirements for medical cannabis dispensaries. It would be unlawful for a physician to prescribe medical cannabis products to any individual for the purposes of smoking.
8th February 2024: US - South Carolina: Local law enforcement in the cities of Columbia and Greenville are cracking down on hemp products containing THC, causing some companies to pause sales, press reports. “At the end of the day, if it gets you high, it’s illegal in South Carolina. Bottom line,” said 13th circuit solicitor Walt Wilkins. Although South Carolina law is not clear (as explained in our delta-8 THC tracker), CannIntelligence does not believe this is an accurate statement of the law, as hemp products may contain enough delta-9 THC to induce a high in consumers while still containing less than 0.3%. A conflict in law exists in South Carolina, though, as there is no exemption for THC in hemp in the state’s controlled substances law, yet the state’s hemp law allows all hemp cannabinoids and derivatives while limiting delta-9 THC to 0.3%.
5th May 2022: US - South Carolina: The Compassionate Care Act, a bill to legalise medical cannabis, has been killed in the House. The bill was ruled out of order on procedural grounds because it imposed a new tax, which is only allowed for bills that originate in the House, press reports. The procedural move reportedly stunned top senators who had passed the bill in February, and the bill’s sponsor vowed to explore ways of attaching its language to another bill.
