Tennessee: Market and legal data analysis of the cannabis sector

8th October 2024: US - Tennessee: The Tennessee Department of Agriculture has published final rules on hemp products that will make one popular hemp product illegal at the end of the year. Most notably, the rules include a total THC calculation for hemp products that would also account for tetrahydrocannabinolic acid (THCA), thereby banning THCA flower. The rules take effect on 26th December.
16th May 2024: US - Tennessee: Senate Bill (SB) 2427 has been signed into law by governor Bill Lee. SB 2427 allows any entity with a beer permit to “sell at retail any hemp-based product for which all required licenses, permits, or certificates have been obtained authorizing the sale of such product within this state”.
8th January 2024: US - Tennessee: The Tennessee Department of Agriculture has published proposed rules on hemp production and hemp-derived products. Notably, the proposed rules include a total THC calculation for hemp products that would also account for THC acid (THCA), thus potentially banning THCA flower.
19th December 2023: US - Tennessee: The Tennessee Department of Agriculture has posted a notice of rulemaking hearing that includes proposed regulations for the sale of hemp-derived cannabinoid products. The hearing is scheduled for 6th February 2024.
12th May 2023: US - Tennessee: Senate Bill (SB) 378 has been signed by governor Bill Lee and enacted into law. The bill strengthens the regulation on the sale and distribution of products with intoxicating hemp-derived cannabinoids (IHDCs), including delta-8 THC and hexahydrocannabinol (HHC) products, making it illegal – as Class A misdemeanour offence – for under-21s to purchase, possess, or accept these products. SB 378 also imposes an additional sales tax of 5% on IHDC products, and requires producers and retailers of such products to obtain a licence from the Department of Agriculture authorising the engagement in that business prior to the start of business or by 1st January 2024.
27th April 2023: US – Tennessee: Senate Bill 378 has been passed by the House and now heads to the governor’s desk. It would strengthen regulation on the sale and distribution of products with intoxicating hemp-derived cannabinoids (IHDCs), including delta-8 THC and HHC, making it illegal for under-21s to purchase, possess or accept them. It would also impose an additional sales tax of 5% on IHDC products.
19th April 2023: US - Tennessee: Senate Bill (SB) 378 has been passed by the Senate and now heads to the House. 1st March 2023: US - Tennessee: Senate Bill 1104, the Tennessee Medical Cannabis Act, has failed in the Senate. Had it passed it would have legalised the use of medical cannabis on a regulated basis for patients with qualifying medical conditions, established licences, and regulated the processes for cultivating, producing, distributing, transporting, selling, and acquiring cannabis for medical use and research. Most other cannabis-related legislation in Tennessee has also failed or made little progress in the legislature so far this session.
