Ukraine: Market and regulatory data analysis of the cannabis sector

14th November 2024: Lithuania: In Lithuania, the Cannabis Hub.LT 2024 conference exhibition gathered fibre hemp growers, processors and scientists from Lithuania and beyond, media reports. Among other discussions was a proposal to launch the Hemp for Victory 2.0 international initiative, which aims to ease EU administrative restrictions on the fibre hemp business and support its development in Ukraine. Hana Gabrielová from the European Industrial Hemp Association emphasised the need for regulatory changes to address the challenges of growing fibre hemp and combat its stigma.
6th November 2024: Ukraine: The government has regulated the procedure for obtaining quotas for the circulation of medical cannabis for 2025, the Ministry of Health reports. The business entity must submit an application to determine the quota to the State Medical Service by 15th December 2024. The updated procedure also regulates other elements of the circulation of medical cannabis, including the procedure for the destruction of medical cannabis waste and the procedure for cultivation, among others.
4th November 2024: Ukraine: According to deputy health minister Maryna Slobodnichenko, medical cannabis is not currently cultivated or imported in Ukraine, media reports. While the regulatory regime is in place, manufacturers have yet to enter the market – likely due to economic considerations. At the informational meeting with around 80 companies, 10 expressed interest in growing medical cannabis.
10th October 2024: Ukraine: The Ministry of Health reports that businesses which already have a valid drug licence can start working with medical cannabis. First they must register the plant substance of cannabis as an active pharmaceutical ingredient in the State Register of Medicinal Products.
3rd October 2024: Ukraine: As announced by deputy minister of health Maria Karchevych, pharmacies that will dispense cannabis-based medicine have begun registration in the electronic accounting system for the circulation of medical cannabis (ESORK), media reports.
2nd October 2024: Ukraine: The Cabinet of Ministers has updated the licensing conditions that regulate all stages of circulation of medical cannabis, the Ministry of Health reports. It includes the processes for cultivation, production, storage, transportation, sale, import and export, use, and disposal of plants and medicines made from raw materials. The adopted resolution contains an exhaustive list of documents required for obtaining a licence and conditions for its issuance. It enters into force two months after the publication date (end of November).
30th September 2024: Ukraine: The Ministry of Health has published a list of diseases and conditions for which patients can be prescribed medical cannabis. These include chronic conditions or neuropathic pain and/or spasticity due to the following diseases: malignant neoplasms, diabetic neuropathy, multiple sclerosis, damage to the trigeminal and facial nerve, neuralgia due to shingles, damage to nerve roots and plexuses, compression of nerve roots and plexuses in diseases, mononeuropathy of the upper limb, mononeuropathy of the lower limb, polyneuropathies and other lesions of the peripheral nervous system, cerebral palsy and other paralytic syndromes, spinal cord injuries, and intracranial injuries. The list also includes nausea and vomiting due to chemotherapy during treatment of neoplasms, Parkinson’s disease, Tourette syndrome, refractory (drug-resistant) epilepsy, diseases causing seizures in childhood (Lennox-Gastaut syndrome, Dravet syndrome, tuberous sclerosis), and weight loss associated with anorexia in patients with HIV. Other diseases could be also treated with medical cannabis, but only based on the opinion of the medical and advisory commission.
9th September 2024: Ukraine: The launch of the e-system for monitoring the circulation of medical cannabis is scheduled for 1st October, media reports. The e-system will allow every stage of the process to be tracked, from growing plants to the manufacture of medicines and their sale to end users. This could help prevent potential abuse.
4th September 2024: Ukraine: The Cabinet of Ministers has regulated the procedure for processing documents for the transportation of medical cannabis by amending resolution 366 “On Approval of the Procedure for Transportation of Narcotic Drugs, Psychotropic Substances and Precursors on the Territory of Ukraine and Registration of Necessary Documents”, media reports.
28th August 2024: Ukraine: The Ministry of Health organised an intergovernmental meeting to discuss the implementation of law 3528-IX (the Cannabis Plants Amendment) that establishes strict control over the cultivation, production and sale of cannabis-derived drugs and entered into force on 16th August, media reports. In the meeting, it was confirmed that a complete list of conditions under which a doctor would be able to issue an e-prescription for medical cannabis-based drugs would be approved soon.
19th August 2024: Ukraine: Law 3528-IX (the Cannabis Plants Amendment) – which establishes strict control over the cultivation, production and sale of cannabis-derived drugs – entered into force on Friday, 16th August 2024.
26th July 2024: Ukraine: The government has adopted a resolution introducing an electronic information system that will ensure transparent regulation of the circulation of medical cannabis, the Ministry of Health reports. Among other data, the system will record the production of medical cannabis seeds, sowing, cloning, planting plants, sending samples for laboratory testing, collecting plants, transporting, purchasing, manufacturing medications, dispensing at a pharmacy, etc. The resolution will enter into force on 16th August. The system is expected to be operational in October.
