Wyoming: Market and legal data analysis of the cannabis sector

19th August 2024: US - Wyoming: Wyoming’s ban on the sale of hemp products containing delta-8 THC or any synthetic substances will remain in place after a federal judge granted the state’s motion to dismiss the case. The lawsuit was brought by several hemp companies in the state claiming that Senate File 32 is preempted by the federal 2018 Farm Bill. The judge reiterated in his ruling that the plaintiffs did not prove the statute is unconstitutional, including claims the ban violates interstate commerce law. “The fact that the plaintiffs are unhappy with the substances (the ban) prohibits does not make the law vague,” judge Rankin said, according to local media. The plaintiffs have filed an appeal to the 10th Circuit Court of Appeals.
26th July 2024: US - Wyoming: A court has denied a preliminary injunction to prevent the state from enforcing the recently passed Senate File (SF) 32. SF 32 bans the sale of hemp products containing delta-8 THC or any synthetic substances and applies a post-decarboxylation calculation for THC in hemp products. The lawsuit was brought by several hemp companies in the state, who claimed that SF 32 is preempted by the federal 2018 Farm Bill. The new law took effect on 1st July and will now remain in effect while the underlying lawsuit is litigated.
5th March 2024: US - Wyoming: Senate File (SF) 32 has been passed by the House and now heads to the governor’s desk. SF 32 would prohibit the addition of synthetic substances to hemp products. According to the bill, “synthetic substance” would mean any synthetic cannabinoid or psychoactive substance. Further, it would specifically include delta-8 THC in its list of prohibited THC. The bill would also prohibit the sale of hemp containing more than 0.3% THC on a dry-weight basis when using post-decarboxylation or another similarly reliable testing method, thus accounting for THC acid (THCA) in the calculation for hemp products.

1st March 2023: US - Wyoming: House Bill 108 has been signed by the governor and enacted into law. It will prohibit from 1st July the sale of vaping and edible products that contain THC or THC analogues to under-18s. However, it would implicitly allow the sale of such products to adults.
24th February 2023: US - Wyoming: House Bill (HB) 108 was passed by the Senate and now heads to the governor for final approval. HB 108 would prohibit the sale of vaping and edible products that contain THC or THC analogues to anyone under the age of 18. However, it would implicitly allow the sale of such products to adults.
8th February 2023: US - Wyoming: House Bill 137, which would have prohibited sales or giving of CBD products to anyone under 21, failed in committee.
