The Brazilian Superior Court of Justice (STJ) issued a ruling on 13th November 2024 that legalised hemp with up to 0.3% THC for medicinal and industrial purposes. This includes the importation of seeds and cultivation carried out by Brazilian companies. The decision is binding on all Brazilian courts.
The STJ has called on the National Health Surveillance Agency (Anvisa) to issue regulations in accordance with this decision within six months. However, in December, the Attorney General’s Office petitioned the STJ to grant authorities an additional six months – amounting to 12 months in total – to issue those regulations, citing challenges in coordination and political-administrative alignment between several government agencies.
