Regulatory report: US state-by state regulation of delta-8 THC

CBD-Intel previously opined that delta-8 THC should be legal on the federal level, but each state has different laws affecting the legality of it inside its borders. Much like with federal law, though, the analysis is complicated, and the issue of legality is murky.

This report addresses the relevant laws and opines on status of delta-8 THC products in each state. However, due the complexity of the law and states’ varying degrees of tolerance for the products, it is often not clear until a state comes forth with a stance or enacts regulations or legislation aimed directly at delta-8 THC. For these reasons, the legality of delta-8 THC in a given state is usually not a clear “yes” or “no”. They are all varying shades of grey.
