Belgium: British American Tobacco (BAT) is to take a challenge to Belgium’s top administrative court, the Council of State, against the royal decree banning nicotine- and cannabinoid-containing pouches, press reports. BAT will argue that health minister Frank Vandenbroucke did not wait for an opinion from the Superior Health Council and did not take into account recent scientific research on the subject before announcing the ban, which is due to come into effect on 1st October.

Belgium: Health minister Frank Vandenbroucke has banned the sale of cannabinoid-containing pouches, along with nicotine pouches, through a royal decree which will come into force on 1st July (or 1st October for retailers). Vandenbroucke announced in January his intention to ban the pouches after the Belgian government notified a proposal to that effect to the TRIS database in June 2022. That proposal received negative opinions from Croatia, Hungary and Sweden, while the European Commission offered no comment.

Belgium: According to the accompanying report on a new Ministry of Health decree on the manufacturing and sale of e-cigarettes, and the Federal Public Health Service’s official e-cigarette guidance, CBD is considered an additive creating the impression of a beneficial effect on health and so will be banned from nicotine-free e-cigs since they will have to comply with the EU Tobacco Products Directive (TPD). This view conflicts with EU law as laid out in the Kanavape case and is likely to be challenged in court.

Belgium: The Federal Agency for Medicines and Health Products (AFMPS) has told CBD-Intel that delta-8 THC is prohibited as a consumer product, and anyone dealing in it must be licensed by the AFMPS. The agency also said hexahydrocannabinol (HHC) is legal and does not require a licence; however, while there is as yet no official proposal, the regulatory framework might change soon. It added that it is allowed to chemically convert a cannabinoid extracted from hemp to another cannabinoid, as long as neither cannabinoid is banned.
