Oregon: Market and regulatory data analysis of the cannabis sector

29th January 2024: US - Oregon: A lawsuit filed in 2022 that challenged an Oregon law prohibiting shipping cannabis across state lines has been dismissed, press reports. The reason for the dismissal is not entirely clear, though the plaintiff indicates that it will continue pushing the issue. The lawsuit claimed that prohibiting interstate commerce of high-THC cannabis violates the Dormant Commerce Clause of the US Constitution, while Oregon authorities argued that the clause does not apply to controlled substances like cannabis.
13th June 2023: US - New Jersey: The New Jersey Cannabis Regulatory Commission (CRC) has revoked Harmony Foundation’s cannabis cultivation and manufacturing licences due to unpaid licence fees. Across the country, state regulators and government bodies have been implementing significant measures and repercussions against cannabis companies that fail to pay vendors, taxes or business fees. California, Michigan, Nevada, New York and Oregon are some of the states that have been enforcing compliance by tracking miscreants, press reports.
8th May 2023: US - Oregon: Oregon Health Authority (OHA) has issued the first psilocybin service centre licence to EPIC Healing Eugene, allowing psilocybin services to become available soon in Oregon. People over the age of 21 can access psilocybin services without a prescription or referral, but must first complete a preparation session with a licensed facilitator. The service centres will distribute psilocybin products produced by licensed manufacturers and tested by licensed laboratories, and offer optional integration sessions for additional support. However, psilocybin products may not be taken away from the centre. Oregon Psilocybin Services (OPS) has issued three manufacturer licences, one laboratory licence, five facilitator licences, and 84 worker permits to date, and expects to issue more in the coming months.
15th February 2023: US - Oregon: The Oregon Liquor and Cannabis Commission (OLCC) has expanded a recall on cannabis vaping products for containing artificially-derived CBN and synthetic CBC. The recall affects ten product lines, 7,000 sold units, and 500 products still on the market under the Firefly Extracts and Smoke-Rite Wellness brands.
22nd November 2022: US - Oregon: Governor Kate Brown has announced that she is issuing pardons for certain convictions for simple possession of cannabis prior to the state’s legalisation of recreational cannabis. It is estimated that the pardons will affect around 45,000 people and forgive more than $14m in fees and fines.
25th August 2022: US - Oregon: The Oregon Liquor and Cannabis Commission (OLCC) and Curaleaf have reached an agreement whereby the company will pay a fine of $130,000 and have its licence suspended for 23 days for mistakenly labelling some of its THC products as CBD products, press reports. The agreement comes after regulators originally imposed a fine of $200,000 and a 70-day suspension. Curaleaf has been the subject of several lawsuits over the mistake.
1st July 2022: US - Oregon: The Oregon Liquor and Cannabis Commission (OLCC) has confirmed to CBD-Intel that as of today (1st July) intoxicating artificially derived cannabinoids, such as delta-8 THC converted from CBD, cannot be made or sold anywhere – including in dispensaries – in the state. Numerous media outlets have been erroneously reporting that such cannabinoid products could still be sold in dispensaries. Artificially derived cannabinoids that are not intoxicating, such as cannabinol (CBN), may continue to be sold in dispensaries until 1st July 2023 if certain conditions are met.
8th April 2022: US - Oregon: The Oregon Liquor and Cannabis Commission has requested a 70-day licence suspension and a $200,000 fine – the maximum monetary fine under state law – against Curaleaf for their mislabelling of high-THC tinctures as low-THC CBD tinctures which led to a recall and several lawsuits against the company, press reports.
5th April 2022: US - Oregon: House Bill 4016 has been signed into law by governor Kate Brown. The new law allows the Oregon Liquor and Cannabis Commission to refuse to issue new cannabis production, processing, wholesale and retail licences “based on supply of and demand for marijuana”. Any moratorium on issuing licences, however, does not apply to licence renewals.
14th March 2022: US - Oregon: Senate Bill 1564 was signed into law by the governor and is effective immediately. The new law allows counties to declare an emergency and request that the state department of agriculture suspend the issuance of new hemp production licences within the county (retroactive to 1st January 2022). At least two Oregon counties have reportedly already declared such an emergency.
3rd March 2022: US - Oregon: Senate Bill 1564 was passed by the House and now heads to the governor’s desk for approval. The bill would allow counties to declare a state of emergency and request that the department of agriculture place a temporary moratorium on issuance of hemp-cultivation licences for the county.
