West Virginia: Market and legal data analysis of the cannabis sector

28th March 2024: US - West Virginia: Senate Bill 679 has been signed by the governor. SB 679 will regulate hemp-derived cannabidiol products that are defined as naturally occurring non-synthetic substances including delta-9 THC with a total concentration of no more than 0.3% on a dry weight basis, delta-8 THC, delta-10 THC, HHC, tetrahydrocannabiphorol (THCp) and tetrahydrocannabivarin (THCv). It would further require permits to manufacture, process, distribute, offer to sell, and sell regulated products.
12th March 2024: US - West Virginia: Senate Bill (SB) 679 has been passed by the House and now heads to the governor. SB 679 would regulate intoxicating hemp-derived cannabinoid (IHDC) products, which are defined as naturally occurring non-synthetic substances including delta-9 THC with a total concentration of not more than 0.3% on a dry-weight basis, delta-8 THC, delta-10 HHC, tetrahydrocannabiphorol (THCP), and tetrahydrocannabivarin (THCV). It would further require permits to manufacture, process, distribute, offer to sell, and sell regulated products.

3rd April 2023: US – West Virginia: Senate Bill (SB) 546 has been signed by the governor and enacted into law. SB 546 adds delta-8 and delta-10 THC, THCO, and “synthetic and non-naturally occurring cannabinoids” as Schedule I substances but exempts any substance or product that is lawfully produced under the state’s hemp law.

SB 546 would add delta-8 and delta-10 THC, THCO, and “synthetic and non-naturally occurring cannabinoids” as Schedule I substances, but would exempt any substance or product that is lawfully produced under the state’s hemp law.
13th March 2023: US - West Virginia: Senate Bill (SB) 220 has been concurred by both chambers and heads to the governor’s desk for final approval. SB 220, called the Industrial Hemp Development Act, would regulate the sale of hemp products that contain “naturally occurring non-synthetic, and unadulterated substances”, specifically including cannabinoids such as delta-8 THC, HHC, and THCV. The bill would further regulate hemp products by imposing labelling requirements, banning sales to under-21s, and imposing a 15% sales tax on retail sales, among other things.

13th September 2022: US - West Virginia: A proposal to cap THC in medical cannabis products at 10% has been rejected by the Medical Cannabis Advisory Board – at least for the time being, press reports. The board said it needed more information before imposing any such cap. The board’s next meeting will be in January 2023.
