Medical cannabis is likely to be regulated soon in Spain as the government has published a draft of the regulation for medicinal cannabis, which is expected to be introduced in Parliament in the coming months. No significant changes are expected in relation to CBD and recreational cannabis as the main ruling party and most opposition parties hold a conservative view when it comes to these products.
The hemp plant is defined by the Ministry of Agriculture, Fisheries and Food (MAPA) as “the term commonly used to refer to the variety of Cannabis sativa L. grown for industrial purposes”. In April 2021, MAPA published an information note providing guidance for the cultivation of cannabis, in which it defined Cannabis sativa L. as “an annual herbaceous plant belonging to the family Cannabaceae that is characterised by having cannabinoid compounds, among which the most relevant are tetrahydrocannabinol (THC) – with a psychoactive effect – and cannabidiol (CBD)”.
Cannabis is classified in Spain as a drug under law 17/1967, which adopted the provisions of the 1961 Single Convention on Narcotic Drugs.
