US - Minnesota: House File 3595 was passed by the legislature as an amendment to HF 4065 and now heads to the governor for final approval. The bill would prohibit the sale of hemp-derived cannabinoid products (including CBD) to under-21s but would explicitly allow hemp-derived edible cannabinoid products if certain testing and labeling requirements are met. It would also cap the amount of any THC in edible products at 5 mg per serving and 50 mg per package. HF 3595 would effectively ban vape products with more than 0.3% of THC (including delta-8) but would still allow delta-8 products in edible form within the THC cap.

The vote provides some clarity for selling hemp-derived products after a court of appeals decision that threw into question the legality of hemp-derived products containing any amount of THC.
