- Czech Republic: The lower chamber of Parliament has passed the proposal to regulate hemp extracts with a THC content of up to 1% and HHC, among other psychoactive substances, media reports. The proposal would restrict sales, prohibit advertising, and introduce registration requirements for such substances. The bill is subject to approval by the European Commission and will need to be approved by the Senate.

- US - Federal: Democrats on the Senate Agriculture, Nutrition, and Forestry Committee, who hold the majority, have released their summary of proposals for the next Farm Bill. In the section addressing hemp, the summary notes defining “industrial hemp” to lower “regulatory barriers for farmers who are growing industrial hemp for grain and fiber” and eliminating the prohibition on “persons who were previously convicted of a felony relating to a controlled substance from participating in the program or producing hemp”. Notably, the summary does not include amending the hemp definition to prohibit deriving intoxicating cannabinoids from hemp.

- US - Missouri: In response to concerns over the safety of certain hemp products, Missouri attorney general Andrew Bailey has launched a consumer protection investigation. His office has issued civil investigative demands (CIDs) to a handful of businesses, with two targeting hemp manufacturers and retailers alleging that the companies may have engaged in illegal means to market and sell these products to Missourians. “This investigation will inquire into the activities and representations of certain sellers in connection with the manufacturing, sale, marketing, advertisement, promotion, and/or distribution of products containing CBD, Delta-8, and Delta-9 THC,” the CID reads. Bailey believes that these companies have used deception, fraud, false promise, misrepresentation and unfair practice in connection with the sale or advertisement of CBD and delta-8 and delta-9 THC products.

- Germany: The Federal Institute for Drugs and Medical Devices (BfArM) has updated the forms for retailers and manufacturers of medical cannabis in accordance with the Medical Cannabis Act, which entered into force on 1st April 2024. Cannabis flowers, extracts, dronabinol, delta-9 THC and preparations made from these substances are now subject to the Medical Cannabis Act. However, medicines containing nabilone are still subject to the regulations of the Narcotic Act.

- US - West Virginia: Senate Bill 679 has been signed by the governor. SB 679 will regulate hemp-derived cannabidiol products that are defined as naturally occurring non-synthetic substances including delta-9 THC with a total concentration of no more than 0.3% on a dry weight basis, delta-8 THC, delta-10 THC, HHC, tetrahydrocannabiphorol (THCp) and tetrahydrocannabivarin (THCv). It would further require permits to manufacture, process, distribute, offer to sell, and sell regulated products.

- US - South Dakota: House Bill (HB) 1125 has been signed by the governor. HB 1125 will prohibit "chemically derived cannabinoids" – which are psychoactive cannabinoids that are changed molecularly through a chemical process (not to include decarboxylation) – from being produced or sold in the state. It will be unlawful to chemically modify or convert industrial hemp, or engage in any process that converts cannabidiol, into delta-8 THC, delta-9 THC, delta-10 THC, or any other tetrahydrocannabinol isomer, analogue, or derivative.

- Finland: The government has recently notified the amendment to the Decree on Psychoactive Substances Prohibited on the Consumer Market to the EU TRIS database. A total of nine new substances will be classified as prohibited psychoactive substances, including tetrahydrocannabiphorol (THCP), hexahydrocannabihexol (HHCH) and delta-8 tetrahydrocannabiphorol (delta-8 THCP).

- US - Federal: A group of 21 state attorneys general (AGs) have sent a letter urging Congress to take action on intoxicating hemp-derived cannabinoid (IHDC) products by updating language of the Farm Bill. The letter argues that vagueness in the 2018 Farm Bill has led to the proliferation of intoxicating hemp products across the nation and challenges the ability for states and localities to respond to the resulting health and safety crisis. “The reality is that this law has unleashed on our states a flood of products that are nothing less than a more potent form of cannabis, often in candy form that is made attractive to youth and children – with staggering levels of potency, no regulation, no oversight, and a limited capability for our offices to rein them in,” the letter says. The group calls for “much-needed improvements to the statute” that would “clarify that there is no federal hemp intoxicants loophole”.

- US - Mississippi: State lawmakers are concerned that intoxicating, hemp-derived cannabinoid (IHDC) products are being sold at fuel stations and other retail establishments, and have highlighted
that kids are not barred enough from buying products like gummies and vapes containing forms of THC, media reports. Republican state representative Lee Yancey said: “Principals were complaining to me that kids are vaping delta-8, delta-10 all day – and are high all day – and get it at the gas station.” State regulators are addressing the uncertainty caused by the lack of clear federal laws, expressing concerns about the risks associated with an unregulated industry that has emerged openly. 6th March 2024
- Czech Republic: The government regulation to add HHC, hexahydrocannabinol-O-acetate (HHC-acetate, HHC-O) and tetrahydrocannabiforol (THCP) to the list of addictive substances was officially published yesterday (5th March) and comes into force today, 6th March.

- US - Florida: The legislative attempts to set THC potency caps on certain cannabis products in Florida seem to have been shelved for this session, media reports. Both House Bill 1269 and Senate Bill 7050, which would have prohibited dispensary sales of adult-use cannabis flower with a potency greater than 30% THC, advanced through committees in both chambers but are now unlikely to move forward due to time constraints. While adult-use cannabis products are not yet legal in Florida, voters may have the opportunity to decide on the issue in November. House sponsor Republican Ralph Massullo confirmed to Politico that the bill is dead this year. “I believe the product we crafted was sound,” said Massullo, while also highlighting that he hopes the legislature will “take up similar policies” in the future if voters approve a legalisation initiative in November.
